Notice of Privacy Practices

THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU OR YOUR CHILD MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

Playworks, LLC (“Playworks”) is committed to protecting the privacy of health information. This Notice describes how we may use and disclose Protected Health Information (“PHI”), our responsibilities regarding that information, and your rights under applicable law.

For services provided to a minor, references to “you” generally include the child's parent, legal guardian, or other personal representative as permitted by law.

Our Responsibilities

Playworks is required by law to:

  • Maintain the privacy and security of protected health information.

  • Provide you with this Notice describing our legal duties and privacy practices.

  • Follow the terms of the Notice currently in effect.

  • Notify affected individuals following a breach of unsecured protected health information when required by law.

How We May Use and Disclose Health Information

Treatment

We may use or disclose PHI to provide, coordinate, or manage occupational therapy and related services.

For example, with appropriate authorization or as otherwise permitted by law, we may communicate with other healthcare providers involved in your child's care.

Payment

We may use and disclose PHI as necessary to obtain payment for services. This may include billing you, submitting claims to insurance, determining coverage, or responding to requests related to payment.

Healthcare Operations

We may use and disclose PHI for activities necessary to operate our practice, including quality improvement, staff training and supervision, credentialing, compliance activities, business administration, and evaluating the quality of our services.

Business Associates

We may share PHI with companies or individuals that perform certain services on our behalf when permitted by law. When required, these organizations enter into agreements requiring them to appropriately protect PHI.

When Required or Permitted by Law

We may use or disclose PHI without written authorization in circumstances permitted or required by law. These may include:

  • Reporting suspected abuse or neglect

  • Responding to certain public health requirements

  • Health oversight activities

  • Certain judicial or administrative proceedings

  • Certain law enforcement purposes

  • Preventing or reducing a serious and imminent threat to health or safety

  • Workers' compensation matters

  • Other circumstances required or permitted by federal or state law

Applicable Illinois law may provide additional protections in certain circumstances.

Uses and Disclosures Requiring Authorization

Uses and disclosures of PHI not otherwise permitted by law generally require your written authorization.

When authorization is required, you may revoke that authorization in writing at any time, except to the extent that we have already acted in reliance on it.

Playworks will not sell your PHI. Uses of PHI for marketing or other purposes requiring authorization will not occur without the authorization required by law.

Communication With Schools, Childcare Providers, and Other Individuals

Playworks may work with schools, childcare providers, caregivers, or other individuals involved in a child's daily activities.

When authorization is required, we will obtain permission from the child's parent, guardian, or other authorized representative before sharing PHI with these individuals or organizations.

Screening or consultation services conducted in a school, preschool, childcare center, home, or community setting remain subject to applicable privacy requirements.

Your Rights

Subject to applicable law, you have the right to:

Obtain a Copy of Your Health Information

You may request to inspect or obtain a copy of health and billing records maintained by Playworks. We will respond within the timeframe required by law and may charge a reasonable, cost-based fee when permitted.

Request Corrections

You may ask us to correct or amend health information you believe is inaccurate or incomplete. We may deny the request in certain circumstances but will explain the reason when required.

Request Confidential Communications

You may request that we contact you in a specific way or at a particular location. We will accommodate reasonable requests as required by law.

Request Restrictions

You may ask us not to use or share certain PHI for treatment, payment, or healthcare operations.

We are not required to agree to every requested restriction. However, when you pay for a healthcare service completely out of pocket and request that information about that service not be disclosed to your health plan for payment or healthcare operations, we will honor the request when required by law.

Receive an Accounting of Disclosures

You may request a list of certain disclosures of your PHI made during the period allowed by law. Certain disclosures, including many disclosures for treatment, payment, and healthcare operations, are not included in this accounting.

Receive a Copy of This Notice

You may request a paper or electronic copy of this Notice at any time, even if you previously agreed to receive it electronically.

Choose Someone to Act for You

If another person has legal authority to make healthcare decisions on your behalf or on behalf of your child, we will recognize that person's authority as required by law.

Changes to This Notice

Playworks reserves the right to change this Notice and our privacy practices as permitted by law.

Any revised Notice may apply to PHI we already maintain as well as information we receive in the future. The current Notice will be available through Playworks.

Playworks will not retaliate against you for filing a privacy complaint.
